The concern was real, but the regulatory apparatus to act on it barely existed. Today, that hypothetical has become urgently concrete. The United States has taken a sharply different path. Rather than a unified federal standard, American businesses face what regulators themselves describe as a patchwork.

Federal agencies like the FTC continue to enforce existing laws against discriminatory or deceptive AI practices, while state-level legislation creates varying requirements depending on location and industry.

The result is a compliance environment that demands constant monitoring.

In December 2025, the tension between state and federal authority sharpened considerably when New York signed laws requiring advertisers to disclose their use of synthetic performers in commercials, and the White House issued an executive order seeking to halt state-level AI regulation in favor of a yet-to-be-determined federal standard.

That standoff captures the central difficulty. Marketers need predictability to build responsible AI systems into their workflows. What they are getting instead is jurisdictional conflict.

The compliance conversation brands keep avoiding

There is a persistent tendency in marketing circles to frame AI regulation as someone else’s problem. Legal will handle it. The platform will handle it. The AI vendor will handle it.

This is noise. It creates a false sense of separation between the people building campaigns and the accountability that regulators are increasingly placing on the brands running them.

The FTC has made this especially clear. Through its Operation AI Comply initiative, the agency has pursued enforcement actions against companies making deceptive claims about their AI products, with findings that extend directly to marketing language.

The brands that are struggling with AI governance are not being held back by regulation; they are being exposed by the gap between the capabilities they adopted and the practices they built around them.

The competitive edge hiding in governance

The brands that will lead in AI-powered marketing are not the ones moving fastest without guardrails. They are the ones building trust fast enough to move freely when others cannot.

This reframe matters. Governance is not a constraint on AI innovation in advertising. It is increasingly a precondition for sustained use of it.

As regulatory enforcement accelerates across jurisdictions, the companies with documented AI practices, clear disclosure standards, and auditable decision-making processes will face far less friction than those who treated compliance as an afterthought.

The EU AI Act’s influence extends well beyond Europe because multinationals cannot run separate standards for separate markets at scale. US companies operating internationally must consider EU requirements, creating pressure for similar domestic standards and potentially accelerating risk-based regulatory approaches in the United States. Brands building toward the higher standard now are effectively future-proofing their operations.

Rebuilding the foundation for accountable AI in advertising

The practical path forward for marketing teams is less about waiting for regulatory clarity and more about closing the internal governance gap that already exists. Three areas deserve immediate attention.

Transparency in AI use has moved from best practice to legal requirement in several markets. New York’s synthetic performer disclosure law is one example of how specific and operational these requirements are becoming. Brands that have not yet built disclosure language into their creative and campaign processes are behind, not ahead.

Audit trails for algorithmic decision-making matter more than most marketing teams realize. When an AI system makes targeting decisions, the ability to explain those decisions, and to demonstrate they are free from discriminatory bias, is increasingly what regulators ask for when things go wrong. Building that documentation capacity into AI workflows now is significantly easier than reconstructing it after an enforcement inquiry.

Finally, the framing of AI ethics as a values exercise rather than a business discipline continues to weaken governance outcomes. The organizations making real progress treat responsible AI use the way they treat financial controls: as infrastructure, not aspiration. That shift in orientation changes which questions get asked, who asks them, and how early in the process they get raised.

The advertising industry has spent the better part of a decade benefiting from AI’s capabilities while deferring the harder questions about accountability. Those questions now have regulators attached to them. The brands that recognize governance as a competitive asset, rather than a compliance cost, are the ones positioned to keep building. The rest are catching up.
